Welcome to A to Z Home Repair WNY (\"we,\" \"us,\" \"our,\" or the \"Company\"). These Terms of Service (\"Terms\") govern your access to and use of our website (www.atozhomerepairwny.com), services, communications (including text messaging/SMS), and any interactions with our business as a handyman and home repair provider in Western New York.

By accessing our website, requesting a quote, booking services, providing your contact information, or using our services in any way, you agree to be bound by these Terms. If you do not agree, do not use our services or provide your information.

1. Services Description

A to Z Home Repair WNY provides general handyman services, home repairs, maintenance, and small improvement projects in the Alden, Clarence, Lancaster, and surrounding Western New York areas. All services are provided on a per-job basis. For any home improvement work valued at $500 or more, New York General Business Law §771 requires a separate written contract signed by both parties, including our name/address/phone, detailed scope/materials, timeline, price/payment schedule, your 3-business-day cancellation right (with exceptions), and other mandatory disclosures. We will provide this required contract before starting such work. These Terms do not replace or serve as that per-job contract.

2. Communications and Text Messaging Consent

By providing your mobile phone number (via our website, quote form, booking, or in person), you expressly consent to receive communications from us, including automated and/or manual text messages (SMS/MMS) and voice calls for scheduling, quotes, appointment reminders, service updates, invoices, payments, follow-ups, and other transactional or service-related messages. Message frequency varies (typically 1-5 messages per job or interaction). Standard message and data rates may apply from your carrier. We do not send unsolicited promotional/marketing texts without additional consent where required.

Important TCPA Compliance Notice: Consent is not a condition of purchasing goods or services. You can opt out of text messages at any time by replying STOP to any message we send (you will receive a confirmation). We comply with the Telephone Consumer Protection Act (TCPA), FCC rules, and CTIA guidelines. We do not share your phone number with third parties for marketing purposes.

3. Payments

Payments are due according to the terms agreed upon for each job (e.g., deposit, progress payments, final upon completion). We accept methods: check, credit card, etc. Late payments may incur fees as stated in your per-job agreement.

TO THE FULLEST EXTENT PERMITTED BY LAW:

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SERVICES AND WORK ARE PROVIDED \"AS IS\" AND \"AS AVAILABLE.\"

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, OR SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST BUSINESS, LOST REVENUES, LOST DATA, OR ANY OTHER ECONOMIC LOSS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO ANY JOB, SERVICES, COMMUNICATIONS, OR THESE TERMS (WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO US FOR THE SPECIFIC JOB OR SERVICES GIVING RISE TO THE CLAIM.

WE ARE NOT RESPONSIBLE FOR PRE-EXISTING CONDITIONS, HIDDEN DEFECTS, LATENT ISSUES, OR DAMAGES CAUSED BY MISUSE, NORMAL WEAR AND TEAR, THIRD PARTIES, ACTS OF GOD, OR EVENTS BEYOND OUR CONTROL AFTER COMPLETION.

THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY ARISING FROM OUR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR INTENTIONAL ACTS.

YOU ACKNOWLEDGE THAT THESE LIMITATIONS ARE A MATERIAL PART OF THE BARGAIN AND THAT WE WOULD NOT PROVIDE SERVICES WITHOUT THEM.

5. Warranties

We warrant our workmanship for 30 days from completion (materials per manufacturer warranties, if any). This is the sole warranty provided. No other warranties, express or implied, apply.

6. Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles. Any disputes arising from our services or these Terms will be resolved exclusively in the courts of Erie County, New York. You agree to resolve disputes individually (no class actions).

7. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance. Check this page periodically.

Auto-Booking Terms & Conditions

A to Z Home Repair WNY

(Applies to all instant/online bookings – Effective December 2025)

By clicking “Book Now,” paying the deposit, or confirming your appointment, you agree to the following:

Fixed Scope & Fixed Price

The job is exactly what is written in the selected service description. No additions or changes can be made online. Any extra work requires a new booking or on-site quote.

Instant Deposit

More than 48 hours notice = full refund or free reschedule.

2-Hour Arrival Window

Your appointment is confirmed for the exact 2-hour window you selected (e.g., 9–11 am). You or an adult must be present the entire window. If we cannot gain access, a $75 trip charge applies and the job must be re-booked.

Site Must Be Ready

Work area cleared, furniture moved, pets secured.

All customer-supplied items (TV, fan, blinds, furniture, hardware, etc.) must be on-site and unboxed when we arrive.

Standard drywall, 8-ft ceilings, 6-ft ladder access only (no plaster, brick, high vaults, or fireplaces).

We Can Refuse or Re-Quote On-Site

If conditions do not match the booked service (wrong wall type, missing parts, unsafe access, etc.), we may:

Decline the job and charge a $75 diagnostic/trip fee, OR

Offer a new price to complete the work (your choice to accept or decline).

Payment

Remaining balance is due immediately upon completion via card on file, cash, Venmo, or Zelle.

30-Day Labor Guarantee

If anything we installed comes loose or fails because of our work in the first 30 days, we return free of charge.

Western New York Weather

In case of severe snow/ice, we may reschedule with no penalty. You will be notified by 7 am the day of service.
